Mitigation
banking is increasingly the favored approach to mitigation for
impacts to wetlands and streams. The Environmental Protection
Agency (EPA) and the Army Corps of Engineers recently released
proposed new rules which will encourage creation and enhancement
of wetlands through mitigation banking as the preferred method
of compensation, in a watershed based approach. Increasingly,
under the new rules, use of “in lieu fee” programs and on site
mitigation will be discouraged, in favor of mitigation banking.
